1. Agreement to These Terms

These Terms & Conditions (“Terms”) govern your use of PegWedig.com and PegWedigCoaching.com (collectively, the “Websites”) and your purchase, access, or use of products and services offered by Wedig Wellness LLC, doing business as Peg Wedig Coaching (“Company,” “we,” “us,” or “our”).

Peg Wedig, also known as Peggy Wedig, provides services through Wedig Wellness LLC and Peg Wedig Coaching and may be referred to in these Terms as “Peg” or “Coach.”

By accessing the Websites, creating an account, purchasing a product or service, enrolling in a program or membership, attending an event or class, using a coaching application, or otherwise using our services, you agree to these Terms and any additional terms presented to you in connection with a specific offering.

You must be at least 18 years old to purchase or participate in our offerings.

If you do not agree to these Terms, do not purchase, access, or use the applicable Websites, products, or services.

2. Scope of Our Services

Peg Wedig Coaching may offer services and products including, but not limited to:

·       Life Coaching;

·       Business Mindset Coaching;

·       one-to-one coaching;

·       group coaching;

·       memberships;

·       courses and educational programs;

·       classes and workshops;

·       live and virtual events;

·       self-coaching programs and tools;

·       coaching applications and AI-supported coaching experiences;

·       hypnosis sessions;

·       prerecorded hypnosis recordings;

·       downloadable materials and resources; and

·       other personal-development and educational offerings.

The specific features, duration, access period, price, schedule, deliverables, and other details of an offering will be described on the applicable sales page, checkout page, enrollment materials, Client Agreement, or other written offer-specific materials.

3. Offer-Specific Terms

These Terms establish the general terms governing our Websites and offerings.

Certain products or services may have additional or different written terms contained in a sales page, checkout page, enrollment agreement, signed Client Agreement, event registration, or similar document.

If there is a direct conflict between these general Terms and written terms specifically applicable to a particular offering, the offer-specific terms will control with respect to that offering.

4. Coaching Relationship

Coaching is a collaborative, co-creative process designed to help clients explore their thinking, increase awareness, identify possibilities, make decisions, and create and implement their own actions.

Life Coaching and Business Mindset Coaching are not partnerships, joint ventures, employment relationships, fiduciary relationships, or professional advisory relationships.

You remain responsible for your own decisions, choices, actions, inaction, implementation, and results.

You agree to participate in coaching in good faith, communicate honestly, remain reasonably open to exploration and feedback, and make reasonable time and energy available for the coaching process.

You are not required to agree with Peg, follow a particular course of action, or make a decision simply because it was discussed during coaching.

5. Coaching Is Not Professional Advice or Treatment

Peg Wedig Coaching does not provide medical, psychological, psychiatric, therapeutic, legal, accounting, investment, tax, or other licensed professional services unless expressly stated otherwise.

Coaching is not psychotherapy and is not a substitute for therapy, medical treatment, mental-health treatment, or other professional care.

Nothing provided through coaching, our Websites, educational programs, memberships, classes, events, hypnosis offerings, self-coaching tools, or coaching application should be interpreted as professional medical, mental-health, legal, financial, tax, or other licensed advice.

If you are currently working with a physician, therapist, mental-health professional, attorney, accountant, financial professional, or other licensed provider, you are responsible for determining whether and when to consult that professional regarding matters within their expertise.

Peg may determine that a particular issue is outside the appropriate scope of Life Coaching, Business Mindset Coaching, hypnosis, self-coaching, or another service and may decline to coach or address that issue and/or recommend that you seek appropriate professional assistance.

6. Business Mindset Coaching and Educational Business Discussions

Business Mindset Coaching may involve discussions related to topics such as content creation, SEO, email marketing, audience development, advertising, monetization, affiliate marketing, sponsorships, social media, artificial intelligence, business growth, products, clients, or other aspects of operating a business.

These discussions occur within the context of Business Mindset Coaching and education. They are not guarantees of business performance and should not be interpreted as legal, tax, accounting, investment, or other licensed professional advice.

You are responsible for evaluating information, making your own business decisions, obtaining appropriate professional advice when necessary, and determining how or whether to implement anything discussed.

7. No Guarantee of Results or Earnings

We do not guarantee any particular personal, professional, financial, business, emotional, or other result.

This includes, without limitation, guarantees concerning:

·       income, revenue, or profit;

·       clients or customers;

·       website traffic;

·       advertising revenue;

·       affiliate income;

·       sponsorship income;

·       product or course sales;

·       audience or email-list growth;

·       social-media growth;

·       search-engine rankings;

·       business profitability;

·       personal transformation;

·       behavior change; or

·       any particular coaching or self-coaching outcome.

Results vary substantially based on individual circumstances, participation, decisions, implementation, market conditions, skills, experience, effort, and factors outside our control.

Testimonials, examples, case studies, and descriptions of results experienced by Peg or other clients are illustrative only. They do not represent a promise or guarantee that you will experience the same or similar results.

8. One-to-One Coaching

Specific one-to-one coaching packages may be governed by a separate Client Agreement.

Unless different terms are expressly provided in that agreement:

One-to-one coaching purchases are nonrefundable, including unused sessions, except where Peg terminates the coaching relationship for reasons unrelated to a material breach by the client as described below.

Unused purchased coaching sessions expire 12 months after the applicable contract effective date unless otherwise stated in writing. If a continuing coaching arrangement is established after fulfillment of an initial package, applicable sessions will expire 12 months after the final payment associated with that arrangement unless otherwise agreed.

Sessions may be conducted through Zoom, telephone, or another mutually agreed method.

Scheduling and Cancellations

Clients must provide at least 24 hours’ notice to cancel or reschedule a coaching session.

When reasonably possible, the parties may attempt to reschedule the session within the same calendar week.

A session cancelled with less than 24 hours’ notice will ordinarily be considered used and count toward the client’s purchased sessions.

If a client is late, the session will ordinarily still end at its originally scheduled time.

If a client has not arrived or contacted Peg within 15 minutes after the scheduled start time, the session may be considered a no-show and count as a completed session.

Planned vacations and holidays communicated in advance may be rescheduled when reasonably possible and will not automatically count as used sessions.

If Peg must cancel a session, the cancelled session will not count as a used session. It will be rescheduled, and the rescheduled session will count as one purchased session when held.

Ending a Coaching Relationship

Peg may determine that a one-to-one coaching relationship should end because of fit, scope, professional boundaries, or another legitimate non-breach reason.

If Peg terminates the relationship for such a reason, the client will receive a refund attributable to the unused portion of the applicable coaching services. Services already provided remain nonrefundable.

If the relationship is terminated because of the client’s material breach of an agreement or these Terms, including serious misconduct or misuse of Peg’s intellectual property, a refund may not be provided.

9. Memberships and Subscriptions

Memberships are month-to-month subscriptions unless the applicable offer expressly states otherwise.

Membership fees are paid in advance using the payment method maintained for the account.

A membership may include an initial enrollment payment or price that differs from the recurring monthly subscription price. The specific pricing and inclusions will be disclosed at purchase.

Membership payments are nonrefundable.

Automatic Renewal

Unless cancelled, a membership will automatically renew for successive monthly billing periods at the applicable subscription rate.

You authorize us and our payment processor to charge the payment method associated with your account for recurring membership fees.

Cancellation

You may cancel your membership through the applicable membership or account portal.

Cancellation stops the next scheduled renewal. You will ordinarily retain access through the end of the billing period for which you have already paid.

There are no prorated or partial refunds for unused portions of a billing period.

At the end of the paid billing period, access to the membership and everything included as part of that membership ends, including any initial course, training, program, coaching application, resources, or other membership content.

Membership Pricing

As long as you remain continuously subscribed, your existing recurring monthly membership rate will remain in effect unless the specific offer expressly provides otherwise.

If your membership ends and you later rejoin, you will be subject to the then-current initial enrollment price and recurring monthly subscription price.

Failed Payments

If a recurring membership payment fails, access may be suspended immediately.

You will have up to 30 days to update your payment information and resolve the outstanding payment. If payment is not successfully resolved within that period, the membership may be terminated.

10. Standalone Courses and Digital Programs

Purchases of standalone courses, digital programs, and similar digital products are nonrefundable unless the specific offer expressly states otherwise.

For standalone courses and digital programs, we will provide access for as long as we continue to host and support the applicable product, with a minimum access period of 12 months from the purchase date unless a longer period is expressly promised.

This 12-month minimum does not apply to content included as part of a membership. Membership content is available only while the applicable membership access remains active.

We do not use the term “lifetime access” to mean that a product must be hosted indefinitely unless that promise is expressly made in writing.

11. Classes and Workshops

Purchases of online or in-person classes and workshops are nonrefundable once purchased unless the specific offer expressly states otherwise.

Registrations are nontransferable unless the specific offer expressly permits transfers.

If we cancel, postpone, or substantially reschedule a class or workshop, we may, depending on the circumstances, provide an appropriate remedy such as a rescheduled date, comparable replacement, credit, or refund.

12. Live Events

Registrations and tickets for live events, retreats, seminars, and similar experiences are nonrefundable unless expressly stated otherwise.

Registrations are nontransferable unless the applicable offer expressly permits transfer.

If an event is cancelled, postponed, or substantially rescheduled by us, we may provide a rescheduled date, comparable replacement, credit, refund, or another reasonable remedy depending on the circumstances.

Optional Activities

Some live offerings may include optional physical, wellness, experiential, or recreational activities.

Participation is voluntary. You are responsible for determining whether an activity is appropriate for you and for choosing whether to participate.

Certain activities may require a separate acknowledgment or waiver.

13. Hypnosis Services and Recordings

We may offer individual hypnosis sessions, hypnosis-related classes, programs, educational materials, or prerecorded hypnosis recordings.

These offerings are intended for personal development, education, relaxation, behavior change, self-improvement, or similar purposes as applicable to the particular offering.

Hypnosis is not medical or mental-health diagnosis or treatment and is not a substitute for appropriate licensed professional care.

Individual experiences and results vary, and no particular outcome is guaranteed.

Safety When Using Hypnosis Recordings

Never listen to or use a hypnosis recording while driving, operating machinery, performing an activity requiring your full attention or alertness, or in another situation where reduced attention could create a safety risk.

14. Emotional Discomfort and Appropriate Use

Coaching, self-coaching, personal development, and hypnosis may involve exploring uncomfortable thoughts, beliefs, emotions, patterns, or experiences.

Ordinary discomfort, resistance, uncertainty, or challenging thoughts can be a normal and meaningful part of personal growth. The fact that a process feels uncomfortable does not necessarily mean that something has gone wrong.

At the same time, you should not force yourself to continue when you are significantly emotionally overwhelmed, highly distressed, unable to think clearly, feeling unsafe, destabilized, or otherwise beyond what you can reasonably process.

If this occurs, you should pause or discontinue the applicable exercise, coaching process, self-coaching process, hypnosis experience, or application use and seek appropriate human, professional, or emergency support as circumstances warrant.

15. Coaching Application and Self-Coaching Technology

We may provide access to a digital coaching application, AI-supported coaching experience, or other interactive self-coaching technology (“Coaching App”).

The Coaching App is designed to facilitate self-reflection and guide users through a coaching process. It is not designed to make decisions for you or tell you what you should do.

You remain solely responsible for evaluating what arises through the process and determining what, if anything, you choose to do.

If, because of the nature of AI-generated or automated technology, the Coaching App generates language that could reasonably be interpreted as advice, a recommendation, instruction, or suggestion, you are solely responsible for evaluating that information before acting upon it.

The Coaching App does not provide medical, mental-health, legal, financial, tax, or other licensed professional advice.

Not for Crisis Use

The Coaching App is not a crisis-intervention service.

It is not intended for use when you are significantly emotionally overwhelmed, highly distressed, unable to think clearly, feeling unsafe, or otherwise unable to thoughtfully engage in self-coaching.

The Coaching App is not monitored by Peg or another person in real time. Information you enter into the Coaching App is not a direct communication to Peg Wedig or Wedig Wellness LLC and should never be used to request emergency or crisis assistance.

If you are experiencing an emergency or immediate safety concern, seek appropriate emergency or professional assistance rather than relying on the Coaching App.

16. Responsible and Intended Use of the Coaching App

The effectiveness and usefulness of a self-coaching process depend substantially on the information and engagement provided by the user.

You agree to use the Coaching App in good faith and for its intended self-coaching purpose.

This includes providing information that is truthful, accurate, and reasonably complete; engaging thoughtfully and in good faith with the questions and process; not intentionally withholding or misrepresenting material information for the purpose of manipulating the process; following applicable instructions; and not deliberately attempting to bypass or manipulate the App’s intended coaching function.

Dissatisfaction with an outcome, not reaching a desired conclusion, experiencing ordinary discomfort, disagreeing with what the coaching process surfaces, or choosing not to act upon something explored through the process does not, by itself, establish that the Coaching App failed to function as intended.

If you claim that the Coaching App did not function properly, we may reasonably request information demonstrating your use of the App and your good-faith participation in the process, while respecting applicable privacy obligations.

Nothing in this section creates a performance guarantee or refund right.

17. Reporting Technical Problems

If you believe the Coaching App, membership platform, course platform, or another digital service is experiencing a technical or functional problem, you agree to promptly notify us and provide a reasonable opportunity to investigate, troubleshoot, and, where appropriate, correct the issue.

Continuing to use a service without reporting a known problem and later asserting that the service was not provided does not automatically establish a right to a refund.

18. Technology and Availability

We make reasonable efforts to maintain access to our Websites and digital offerings but do not guarantee uninterrupted or error-free availability.

Temporary outages, maintenance, internet disruptions, third-party platform failures, AI-provider interruptions, software issues, payment-provider interruptions, or other technological circumstances may occasionally affect access.

A temporary interruption does not automatically create a right to a refund.

If a significant interruption materially affects a paid service, we will make reasonable efforts to restore access or provide an appropriate alternative based on the circumstances.

19. Third-Party Technology and Intellectual Property

Our offerings may rely upon third-party software, artificial-intelligence technology, hosting platforms, payment processors, communication platforms, or other technology.

Wedig Wellness LLC does not claim ownership of third-party technology or underlying AI models owned or licensed by others.

However, our use of third-party technology does not diminish our ownership of our own proprietary intellectual property, including our frameworks, methodology, prompts, questions, sequencing, coaching processes, workflows, exercises, structure, organization, educational materials, training materials, content, branding, and other original elements incorporated into or delivered through our offerings.

20. Your Content in the Coaching App

You retain ownership of the personal content you enter into the Coaching App, such as your thoughts, responses, reflections, goals, and business information.

You grant Wedig Wellness LLC and its authorized service providers a limited right to process, store, transmit, and otherwise use that information as reasonably necessary to provide, operate, maintain, secure, troubleshoot, and improve the service, subject to our Privacy Policy and applicable law.

We may use de-identified or aggregated information regarding use of the Coaching App—such as usage patterns, commonly used features, process flow, general categories of friction, or points where users tend to stop—to understand and improve the Coaching App, our frameworks, and our educational offerings.

You may also voluntarily choose to share specific experiences, entries, screenshots, outcomes, difficulties, or other information directly with Peg for feedback, troubleshooting, research, or improvement.

Your voluntary sharing of that information does not give us permission to publicly disclose or use it in an identifiable manner. Separate permission will be obtained before personally identifiable information voluntarily shared with us is used publicly or for identifiable marketing purposes.

21. License to Use the Coaching App

Access to the Coaching App is licensed, not sold.

During your authorized access period, you receive a limited, personal, non-exclusive, nontransferable, and revocable right to use the Coaching App for your own personal self-coaching purposes.

When your membership or other authorized access ends, your right to access or use the Coaching App ends.

You acquire no continuing ownership or usage rights in the App, its processes, prompts, questions, workflows, methodology, or proprietary content.

22. Intellectual Property

The Websites and our free and paid materials contain intellectual property owned by or licensed to Wedig Wellness LLC.

This may include, without limitation:

·       The Spiral;

·       The Friction Finder;

·       The Tool Box;

·       Mist List;

·       proprietary coaching methodologies;

·       coaching questions;

·       prompts;

·       workflows;

·       exercises;

·       processes;

·       app structure and sequencing;

·       courses;

·       lessons;

·       videos;

·       recordings;

·       worksheets;

·       PDFs;

·       downloads;

·       articles;

·       website copy;

·       photographs;

·       graphics;

·       branding;

·       program and product names; and

·       other original content and materials.

Making content available to view for free does not place that content in the public domain or give others permission to copy or commercially exploit it.

Unless we expressly provide written permission, our materials are provided solely for your own personal use.

23. Prohibited Uses of Our Intellectual Property

Without our prior written permission, you may not copy, reproduce, republish, distribute, sell, sublicense, license, teach, train from, publicly share, adapt, translate, modify, create derivative works from, commercially exploit, or otherwise reproduce our proprietary materials.

You may not recreate our materials “in your own words” or “in your own voice” in an attempt to avoid these restrictions.

You may not use our proprietary frameworks, materials, or methods to coach, teach, train, or provide services to your own clients unless you have a separate written license or authorization expressly allowing that use.

Giving Peg Wedig, Peg Wedig Coaching, or Wedig Wellness LLC credit does not substitute for obtaining permission.

24. AI, Scraping, Reverse Engineering, and Competitive Use

Our proprietary materials may not be fed into, uploaded to, copied into, scraped by, or systematically extracted for use with an artificial-intelligence system for the purpose of reproducing, analyzing, imitating, teaching, repackaging, or creating a derivative or competing offering.

You may not use our Coaching App, courses, membership content, prompts, questions, workflows, frameworks, methodology, outputs, organization, logic, exercises, or other proprietary elements to create, train, improve, benchmark, or develop:

·       another coaching application;

·       AI coach;

·       chatbot;

·       custom GPT or similar AI tool;

·       prompt library;

·       coaching methodology;

·       course;

·       membership;

·       framework;

·       training program;

·       certification;

·       consulting product; or

·       other competing or derivative product or service.

You may not reverse-engineer or attempt to discover the underlying proprietary prompts, logic, workflows, coaching sequences, methodology, or architecture of our Coaching App or other proprietary systems.

We reserve the right to refuse, suspend, or terminate access if we reasonably determine that a person purchased or accessed an offering primarily to copy, study, extract, reverse-engineer, benchmark, develop, or improve a competing or derivative offering.

A material violation of this section may result in immediate termination of access without refund and may subject the violating party to additional remedies available under applicable law.

25. Brand and Affiliation Restrictions

You may not use the names Peg Wedig, Peg Wedig Coaching, Wedig Wellness LLC, our logos, program names, framework names, product names, or other branding in a manner that falsely or misleadingly suggests that you are certified by, affiliated with, sponsored by, endorsed by, licensed by, trained by, or authorized to represent us.

Participation in or purchase of one of our offerings does not create certification, licensing, endorsement, or authorization to represent our business or methodology unless expressly provided through a separate written agreement.

26. Downloaded Materials

Materials that we intentionally make downloadable may be downloaded during your authorized access period.

If your relationship, course access, or membership later ends, you may retain materials that you legitimately downloaded while your access was active.

You do not retain access to download future materials or materials you did not download before your access ended.

Retaining a downloaded copy does not expand your rights in that material. All intellectual-property and personal-use restrictions continue after your access ends.

27. Account Security and Individual Access

Paid accounts, memberships, courses, Coaching App access, private links, and other restricted services are for one individual unless an offer expressly states otherwise.

You are responsible for maintaining the confidentiality and security of your login credentials.

You may not share your account, password, private links, course access, membership access, Coaching App access, or other restricted access with a spouse, partner, employee, contractor, business partner, client, friend, or any other person.

You must promptly notify us if you reasonably suspect unauthorized access to your account.

Unauthorized sharing may result in suspension or termination of access without refund.

28. No Recording by Participants

Unless you receive prior written permission from us, you may not make your own audio recording, video recording, screen recording, screenshot, photograph, transcription, or other reproduction of one-to-one coaching sessions, classes, workshops, group calls, events, Coaching App content, or other protected offerings.

This restriction is especially important in group environments where other participants’ privacy may be affected.

29. Our Recording of Group Offerings and Events

Wedig Wellness LLC, Peg Wedig Coaching, Peg Wedig, and employees, contractors, photographers, videographers, production professionals, service providers, or other individuals or companies authorized by us may photograph, audio record, video record, screen record, or transcribe online or in-person classes, workshops, group coaching sessions, events, programs, and other group offerings.

By participating in an offering for which recording or photography has been disclosed, you acknowledge that you may appear or be heard in photographs, video, audio, recordings, or transcripts created by us or by persons authorized to act on our behalf.

We may use such materials, including participant contributions captured within them, for legitimate business purposes including educational and training materials, future programs and courses, websites, email communications, social media, advertising, marketing, and promotional materials, subject to applicable law and any additional consent requirements applicable to the particular offering.

Where appropriate, additional notice or media-release terms may be provided for a specific event or offering.

This authorization applies only to recordings, photographs, or transcriptions made by us or by persons we have authorized to act on our behalf. It does not give participants permission to photograph, record, screen record, screenshot, transcribe, reproduce, or otherwise capture any portion of an offering. Participant recording remains prohibited as provided in Section 28 unless we give prior written permission.

30. Transcription and/or Recording of Private One-to-One Sessions

Coaching Notes and Transcription

As part of the ordinary coaching process, Peg may take written or typed notes and/or create a written transcription of a private one-to-one coaching session. This is a standard part of Peg's coaching practice and does not require separate written consent from the client.

Coaching notes and transcriptions may be maintained for purposes related to the coaching relationship, professional development, training, quality improvement, development or refinement of coaching methodologies and programs, and other legitimate internal or educational purposes.

Peg may use information derived from coaching notes or transcriptions for training, professional development, educational, research, or program-development purposes only when the information is reasonably de-identified. Peg will not intentionally disclose the client's name, business name, contact information, or other information that reasonably identifies the client without the client's separate written consent, except where disclosure is otherwise permitted or required under these Terms or applicable law.

Audio and Video Recording by Peg

Peg may occasionally wish to audio or video record a private one-to-one coaching session.

When a session is recorded through Zoom or another technology that provides an on-screen recording notice, consent request, acknowledgment, or similar notification, the client will be notified through that technology. By affirmatively acknowledging or accepting the recording notice and continuing with the recorded session, the client consents to the recording.

If the client does not wish to be recorded, the client should decline the recording request or notify Peg before continuing with the recorded portion of the session.

Recordings made with the client's consent may be used by Peg for legitimate training, professional development, educational, quality-improvement, research, or program-development purposes.

Because an audio or video recording may contain the client's face, appearance, likeness, or voice, the client may be recognizable in a recording used for these purposes. However, Peg will not intentionally associate the recording with or disclose the client's name, business name, website, contact information, personal identifying details, or other information that identifies who the client is beyond the appearance, likeness, or voice inherently contained in the recording, unless the client separately provides written consent.

Marketing and Promotional Use

Consent to transcription or recording for coaching, training, professional development, educational, research, quality-improvement, or program-development purposes does not constitute consent to use a private one-to-one client's recording, image, likeness, voice, story, name, business information, or other identifiable information for advertising, marketing, testimonials, social media, promotional materials, or other public promotional purposes.

Peg will obtain separate written consent before using recognizable or identifying material from a private one-to-one coaching relationship for such purposes.

Recording by Clients

Clients are not permitted to audio record, video record, screen record, photograph, screenshot, transcribe, use automated transcription or note-taking technology to capture, or otherwise reproduce a private one-to-one coaching session without Peg's prior written permission.

Peg's recording or transcription of a session does not give the client permission to independently record or reproduce the session.

31. Testimonials and Client Feedback

We may use anonymous or reasonably de-identified client feedback, comments, or results for educational, informational, or promotional purposes where doing so does not reasonably identify the individual.

We will obtain permission before intentionally using a client’s name, photograph, business name, website, recognizable likeness, or other identifying information as a testimonial or endorsement.

Testimonials must reflect genuine experiences and will not be presented as guarantees of typical or expected results.

32. Group Privacy and Confidentiality

Participants in group coaching, classes, workshops, events, communities, or other interactive offerings are expected to respect the privacy and confidentiality of other participants.

You may not record, screenshot, reproduce, publicly discuss, distribute, or disclose another participant’s personal information, story, image, comments, business information, or other private contribution without that person’s permission.

Although we require participants to respect these obligations, we cannot guarantee that every participant will comply. You should use reasonable judgment when deciding what personal, confidential, or sensitive information to disclose in a group environment.

These expectations also apply to interactive community features if and when an offering includes such features.

33. Confidentiality in One-to-One Coaching

Peg Wedig Coaching treats private coaching conversations and client information with care and discretion. However, a coaching relationship is not legally privileged or confidential in the same manner as certain relationships with licensed medical, mental-health, or legal professionals, and clients should not assume that information shared in coaching is protected by a legally recognized privilege.

Except as described below, Peg will not intentionally disclose a client's private or identifying information to third parties without the client's permission. Peg may, however, use reasonably de-identified client situations, themes, experiences, or information for legitimate professional purposes such as training, professional consultation, professional development, supervision, education, or development and improvement of coaching methods and programs, provided the client's identity and reasonably identifying details are not intentionally disclosed.

Legal and Safety Concerns

Confidentiality does not apply when Peg has a reasonable concern involving safety, potential unlawful conduct, a legal obligation, or another situation in which disclosure may reasonably be necessary to protect the client, Peg, another person, or the public.

Peg may disclose relevant information to an appropriate third party without the client's knowledge, permission, or written consent when Peg reasonably believes that:

  • the client or another person may be in danger of serious harm;

  • there is a credible threat or significant safety concern involving the client or another person;

  • information shared during coaching raises a serious concern regarding potentially unlawful conduct;

  • disclosure may be reasonably necessary to prevent, report, investigate, or respond to suspected unlawful conduct or a safety concern;

  • Peg or Wedig Wellness LLC is required to provide information pursuant to applicable law, court order, subpoena, or other valid legal process; or

  • disclosure is otherwise reasonably necessary to protect Peg, Wedig Wellness LLC, the client, another person, or the public in connection with a legitimate legal or safety concern.

Depending on the circumstances, an appropriate third party may include law enforcement, emergency responders, medical or mental-health professionals, legal counsel, an emergency contact, another person reasonably positioned to address the concern, or another appropriate authority or professional.

Peg is not required to obtain the client's permission before making such a disclosure and is not required to delay a disclosure in order to notify or consult with the client first. Peg may act promptly based on the information reasonably available to her at the time.

Where reasonably practicable, Peg will limit a disclosure to information she believes is relevant to addressing the legal or safety concern.

Nothing in this section creates a duty for Peg Wedig Coaching to monitor clients, investigate suspected wrongdoing, provide crisis services, diagnose risk, or assume the responsibilities of law enforcement, emergency services, medical professionals, mental-health professionals, or other licensed professionals.

34. Marketing Communications

Clients and purchasers may receive general email communications from Peg Wedig Coaching containing educational resources, updates, offers, events, programs, or similar information.

You may unsubscribe from marketing communications at any time using the unsubscribe method provided in the communication.

Unsubscribing from marketing communications does not prevent us from sending transactional, account-related, scheduling, billing, service-delivery, or other communications reasonably necessary to provide a product or service you purchased.

35. Direct Access to Peg

Purchasing a membership, course, class, event, hypnosis recording, Coaching App subscription, or other offering does not automatically include individual, unlimited, or on-demand access to Peg Wedig by email, messaging, telephone, Zoom, or another communication method.

Any personal access, coaching, support, office hours, messaging, or other direct interaction with Peg will be limited to what is expressly included in the applicable offer.

36. Bonuses

Bonuses are complimentary additions to the primary purchased offering and do not have a separate cash value unless expressly stated otherwise.

Bonuses may be modified, substituted, updated, or discontinued when reasonably necessary.

Failure to use a bonus, or the later unavailability of a bonus, does not create a right to a full or partial refund of the primary purchase.

37. Modifications to Offerings

We may update, improve, replace, or reasonably modify content, technology, resources, schedules, delivery methods, platforms, features, or materials used to provide an offering.

Such changes may be made to improve an offering, maintain functionality, respond to technological changes, replace unavailable third-party services, or otherwise operate the business effectively.

We will not use this provision to intentionally eliminate a material benefit already expressly promised to an existing purchaser without providing an appropriate alternative or remedy.

38. Client and User Responsibility

You are responsible for the accuracy, completeness, and truthfulness of information you provide in coaching, self-coaching, the Coaching App, classes, programs, or other interactions with us.

Our services can only respond to the information, context, and perspective provided.

Participation alone does not guarantee results.

You remain responsible for your own choices, decisions, actions, implementation, and outcomes.

Our responsibility is to provide the product or service purchased in accordance with the applicable offer and these Terms.

39. Suspension or Termination for Misconduct

We reserve the right to suspend or terminate access to an offering for a serious, repeated, or material violation of these Terms or applicable offer-specific terms.

Examples may include harassment, threatening or seriously disruptive behavior, creating an unsafe environment for others, unauthorized account sharing, material intellectual-property violations, misuse of the Coaching App, unauthorized recording, competitive misuse, or other substantial misconduct.

Where the termination results from the user’s material breach, amounts already paid may remain nonrefundable to the extent permitted by law.

40. Right to Refuse Service

Before services begin, we may decline a purchase or refuse service where we reasonably determine that the offering is not an appropriate fit, is outside our scope, creates a safety or professional-boundary concern, involves abusive or threatening conduct, or presents another legitimate reason not to proceed.

If we refuse a paid service before it begins, payments received for the unprovided service will be refunded.

41. Third-Party Resources and Affiliate Relationships

We may discuss, link to, recommend, or provide information about third-party products, services, software, professionals, platforms, books, tools, or other resources.

These references are provided for convenience, education, or informational purposes and do not guarantee the third party’s performance, accuracy, availability, policies, pricing, security, suitability, or user experience.

You are responsible for evaluating whether a third-party product or service is appropriate for you.

Some links or recommendations may be affiliate relationships through which we may receive compensation if you make a purchase. Where required, affiliate relationships will be disclosed.

42. Payment Disputes and Chargebacks

Before purchasing, you are responsible for reviewing the applicable offer, pricing, refund policy, and these Terms.

By completing a purchase, you acknowledge and agree to the applicable refund policy.

You agree not to initiate a chargeback or payment dispute merely because you changed your mind, failed to use the purchased service, did not achieve a desired result, experienced ordinary dissatisfaction, or no longer wish to participate when the applicable refund policy does not provide a refund.

If you believe a genuine billing error, unauthorized charge, or failure to provide a purchased service has occurred, we ask that you contact us promptly at Peg@PegWedigCoaching.com and provide us a reasonable opportunity to investigate and address the issue.

A chargeback does not itself cancel contractual obligations or create a refund entitlement.

Initiating or threatening a chargeback solely to obtain a refund or concession outside an agreed refund policy does not obligate us to provide that refund or concession.

If a chargeback or payment dispute is initiated, we may immediately suspend access to the disputed product, service, membership, Coaching App, course, or other offering while the dispute is pending. That suspension does not itself create a refund right.

A payment dispute initiated contrary to these Terms and without a legitimate billing basis may constitute a breach of the applicable agreement, subject to applicable law and card-network or payment-provider rights.

Nothing in this section limits any nonwaivable consumer right or your right to dispute a genuinely unauthorized, erroneous, fraudulent, or otherwise legally disputable charge.

43. Refund Policy

Except where a specific offer expressly provides otherwise or where required by law:

·       one-to-one coaching is nonrefundable, subject to the limited unused-service provision described in Section 8;

·       membership and subscription payments are nonrefundable;

·       standalone courses and digital programs are nonrefundable;

·       classes and workshops are nonrefundable;

·       live events and event registrations are nonrefundable; and

·       digital downloads and hypnosis recordings are nonrefundable.

Failure to attend, participate, log in, complete materials, download materials, use available resources, or achieve a desired result does not create a refund right.

44. Honest Reviews and Mutual Conduct

Nothing in these Terms prohibits a client or customer from providing truthful feedback, sharing an honest opinion or review, making a legitimate complaint, communicating with an attorney or governmental authority, participating in a legal proceeding, or exercising any other right that cannot lawfully be waived.

At the same time, both you and Wedig Wellness LLC agree not to knowingly publish or communicate false, defamatory, malicious, or knowingly misleading factual statements about the other party.

This provision applies mutually and is not intended to suppress criticism, honest negative reviews, differences of opinion, or truthful descriptions of an experience.

45. No Warranties

To the fullest extent permitted by applicable law, the Websites and our products and services are provided on an “as is” and “as available” basis.

We make no express or implied guarantee that the Websites, Coaching App, programs, coaching, courses, recordings, materials, or other services will produce a particular result or operate without interruption or error.

Nothing in this section excludes a warranty or consumer protection that cannot legally be excluded.

46. Limitation of Liability

To the fullest extent permitted by applicable law, Wedig Wellness LLC, Peg Wedig Coaching, Peg Wedig, and their authorized employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Websites or our products or services.

To the fullest extent permitted by applicable law, our aggregate liability arising from a particular purchased product or service will not exceed the amount you actually paid to Wedig Wellness LLC for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

47. Force Majeure

We will not be considered in breach of these Terms for a delay, interruption, cancellation, or inability to perform caused by circumstances beyond our reasonable control.

Examples may include severe weather, natural disaster, widespread technological or utility outage, governmental action, serious illness or emergency, venue closure, transportation disruption, labor disruption, public-health emergency, failure of critical third-party infrastructure, or another extraordinary event outside our reasonable control.

When such circumstances materially affect a paid offering, we will determine an appropriate response based on the circumstances, which may include rescheduling, substitution, credit, an alternative delivery method, or refund where appropriate.

48. Reasonable Accommodations

If you require a reasonable accommodation to participate in a live event, class, workshop, group offering, or similar experience, please contact us sufficiently in advance so we can evaluate the request.

We will make reasonable efforts to determine what accommodations can reasonably be provided based on the offering, venue, technology, timing, and circumstances. We cannot guarantee that every requested accommodation will be possible.

49. Employees, Contractors, and Service Providers

Wedig Wellness LLC may use authorized employees, virtual assistants, contractors, developers, technology providers, and other service providers to operate the business and deliver services.

Such persons may receive access to information only to the extent reasonably necessary to perform their authorized work and subject to appropriate confidentiality, contractual, and data-protection obligations.

Additional information regarding collection, processing, and disclosure of personal information will be addressed in our Privacy Policy.

50. Dispute Resolution

If a dispute arises relating to these Terms or a product or service provided by Wedig Wellness LLC, the parties agree first to make a good-faith effort to resolve the matter directly.

If the dispute cannot be resolved through reasonable direct discussion, the parties agree to attempt in good faith to resolve the dispute through mediation before initiating court proceedings, except where immediate judicial relief is reasonably necessary or where applicable law provides otherwise.

If the dispute remains unresolved, any court proceeding will be brought in a court of competent jurisdiction located in Waukesha County, Wisconsin, to the extent such venue selection is legally enforceable.

Each party will ordinarily be responsible for its own attorneys’ fees and costs unless applicable law, a court order, or another enforceable agreement provides otherwise.

51. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

52. Changes to These Terms

We may revise these Terms from time to time.

Updated general Website Terms will become effective when posted with a revised “Last Updated” date unless otherwise stated.

Changes will generally apply prospectively and will not retroactively eliminate a material benefit expressly promised to an existing purchaser.

For ongoing month-to-month offerings, updated terms may apply to future renewal periods after appropriate notice where required, subject to any specific contractual commitments made to existing members.

53. Electronic Acceptance

Your electronic acceptance of these Terms, including through a checkbox, electronic signature, purchase, enrollment, registration, account creation, or continued authorized use where legally appropriate, may constitute your agreement to be bound by them.

Electronic records and signatures may be used to evidence your acceptance.

54. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Wedig Wellness LLC may assign its rights or obligations in connection with a legitimate sale, transfer, restructuring, succession, or reorganization of the business, subject to applicable law.

55. Waiver

Failure by either party to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or the right to enforce it in the future.

56. Severability

If a provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as necessary, and the remaining provisions will remain in effect.

57. Entire Agreement

These Terms, together with the applicable Privacy Policy and any offer-specific sales terms, checkout terms, Client Agreement, enrollment agreement, or other written agreement applicable to a particular purchase, constitute the agreement governing the applicable relationship.

Where an offer-specific written agreement directly conflicts with these general Terms, the offer-specific agreement controls with respect to that offering.
